Every year Việt Nam’s communes review which households count as poor or near-poor. The result decides who gets free health insurance, school fee waivers, subsidised credit and a long list of other benefits. For years that register lived in a patchwork of spreadsheets, provincial software and a central database with only technical guidance behind it. Thông tư 46/2026/TT-BNNMT turns it into a regulated data asset under the Luật Dữ liệu, with named owners, a field-level dictionary and measurable targets.
What the document is
The full title is Thông tư quy định Kiến trúc dữ liệu, Khung quản trị, quản lý dữ liệu và Từ điển dữ liệu lĩnh vực giảm nghèo, a circular on the data architecture, the data governance and management framework, and the data dictionary for the poverty reduction sector. Thứ trưởng Bộ Nông nghiệp và Môi trường Nguyễn Hoàng Hiệp signed it on behalf of the Minister in Hà Nội on 29 October 2026, at the proposal of the Chánh Văn phòng Điều phối Trung ương of the national target programmes (new rural development, sustainable poverty reduction, and socio-economic development in ethnic minority and mountainous areas). The Government portal published the signed text the same day. It runs to six chapters, 22 articles and 16 annexes, 145 pages in all, and takes effect on 15 December 2026.
Its legal basis is the modern data stack: Luật Dữ liệu 60/2024/QH15 as amended by Luật 116/2025/QH15, Luật Giao dịch điện tử 20/2023/QH15, Nghị định 165/2025/NĐ-CP (implementing the Data Law), Nghị định 194/2025/NĐ-CP (national databases and open data), Nghị định 278/2025/NĐ-CP (mandatory data sharing across the political system) and Nghị định 351/2025/NĐ-CP, which sets the national multidimensional poverty standard for 2026 to 2030.
Where it sits in the data-law rollout
This is the sector layer of a three-tier structure. The Prime Minister issued the national data architecture framework, governance framework and shared data dictionary (version 1.0) under Quyết định 2439/QĐ-TTg on 4 November 2025. Bộ Nông nghiệp và Môi trường then issued its own ministry-wide framework under Quyết định 1805/QĐ-BNNMT on 19 May 2026, whose Điều 3 ordered each specialised department to draft a sector circular following the template in its Phụ lục 10. The first one out was Thông tư 43/2026/TT-BNNMT for forestry, signed on 30 September 2026 and effective 20 November 2026. Poverty reduction is the second.
Before this, the register was governed by Quyết định 4092/QĐ-BNNMT of 3 October 2025, a technical regulation for the poor and near-poor household database. That decision placed the central database at the ministry under the Văn phòng Quốc gia về giảm nghèo and left provincial databases with the provincial People’s Committees. Thông tư 46 does not repeal it by name. It contains no repeal clause at all. Instead Điều 22 lets existing systems keep running while they are migrated, and requires systems still under construction to be adjusted to the new rules.
What the register will hold
Điều 5 lists the data components. Household data: a household code, the registered and the actual address, urban or rural location, and management status. Member data: the số định danh cá nhân (personal identification number), full name, relationship to the head of household, date of birth, sex, ethnicity, and levels of schooling and training. Then living conditions and assets (housing, electricity use, water source, latrine, sanitation, household and production assets), review and scoring records, classification and recognition decisions and certificates, causes of poverty and support needs, history (exit from poverty, relapse, new cases), statistics and management records. Spatial data must use the VN-2000 national coordinate system. Unstructured data, meaning photos, video, audio, messages and scanned files, is in scope too.
Two rules give this structure teeth. Điều 7 says identifiers are the core of the model: where a national or shared identifier already exists, it must be used, and no duplicate business code may be issued. Điều 3 says data is created once at source and never re-collected if it already exists in a connected database. In practice that means a commune officer should not be re-typing a citizen’s date of birth; the Cơ sở dữ liệu quốc gia về dân cư is named as the single reference source for personal identity, and the architecture annex requires every household member to be verified against it.
Who owns and who does what
Chapter III and Phụ lục X set out the governance framework. The ministry is the data owner; the Văn phòng Điều phối Trung ương is the data controller (chủ quản) responsible for content and technical guidance; Cục Chuyển đổi số runs the shared infrastructure and platform; provincial Sở Nông nghiệp và Môi trường manage data locally; and the commune People’s Committee is the data creator, answerable for accuracy, completeness, timeliness and correcting its own errors. The annex maps these to Data Owner, Data Steward and Data Custodian roles and to the five functional units required by the national framework, and states that the assignment does not create new organisational units. Phụ lục XI translates it into a RACI matrix with service-level targets.
Hosting may be on the ministry’s own infrastructure, the Trung tâm dữ liệu quốc gia (national data centre) or any other infrastructure that meets the information security level required.
Sharing, VNeID and the one-day rule
Điều 19 fixes the channels. Inside the ministry, data moves over its own data sharing and coordination platform (LDOP); between central and local levels, over the shared system or LDOP; with other ministries and agencies, over the national platform (NDOP) for anything on the mandatory sharing list. Receiving agencies must scan for malware and may suspend or refuse a feed that fails the check.
The architecture annex spells out who gets what. Identity is verified against the population database. Recognition results for poor and near-poor households are shared with health insurance, education and the social policy credit system. Citizens can file review requests through the Cổng Dịch vụ công quốc gia, through VNeID or in person, and VNeID is also a results channel. Two KPIs put a clock on it: from 2027, the share of recognised households whose result reaches mandatory-sharing partners, and the social policy credit system specifically, with a confirmed receipt within one working day of the update.
Personal data and open data
Điều 3 classifies poverty data into basic and sensitive personal data under Điều 3 and Điều 4 of Nghị định 356/2025/NĐ-CP, the Personal Data Protection Law’s implementing decree. The data dictionary then tags individual fields. Ethnicity, the health insurance number and the household’s coordinates are marked “high, sensitive personal data”; names, dates of birth, phone numbers and detailed addresses are “high, personal data”. The public posting of review results in villages must mask personal information. KPI-12 requires every access to a sensitive field to leave a complete log entry. Data subjects may access their own records under personal data protection law.
Five aggregate datasets become open data under Phụ lục III, in API, JSON, XML, CSV and Excel formats: poverty statistics by area down to commune level, figures by target group, figures by ethnic group (province level and above only, with no commune-level ethnic breakdown), figures by cause of poverty, and the poverty standard itself. The circular adds two careful caveats: the register’s figures are administrative numbers and do not replace the national multidimensional poverty indicator compiled by Bộ Tài chính, and commune-level data must apply an anti-reidentification rule.
Targets and migration
Phụ lục XIII sets 14 KPIs with baselines. Metadata coverage of the dictionary’s 66 tables and 141 fields starts at 0 percent. Naming-rule compliance starts at 74 percent (49 of 66 tables). Open dataset publication starts at 0 of 5. Verified personal IDs, duplicate households, first-pass validity of review forms and five-working-day entry of recognition decisions are to be measured at the 2026 review round. Evaluation is annual, and the results feed the 2026 to 2030 roadmap.
Điều 14 governs legacy data in three phases: assess and classify old systems and plan; convert and standardise; then evaluate quality, integrate, end parallel running and retire the old system. Data that cannot be mapped is escalated to the system’s governing body; nothing may be edited, deleted or destroyed unilaterally. No calendar dates are attached to the phases.
Practical implications
- Commune officials become the legally responsible data creators. The one-time-at-source rule and population-database verification should remove re-keying, but the five-day entry deadline and first-pass validity KPI will be measured on them from the 2026 review.
- Provinces and their software vendors must bring local poverty systems into line with the 66-table, 141-field dictionary in Phụ lục XV, including table-naming rules, ISO 19115 metadata recorded automatically, and the ministry’s LDOP interfaces. Procurement under way before 15 December 2026 has to be re-checked against the circular.
- Health insurance, education and social policy credit systems will receive recognition results through mandatory sharing with a one-day confirmation target from 2027, which removes a paper step from benefit delivery.
- Households must provide truthful information, can access their own data, and from the public-posting rule gain some protection against their details being pinned up in full.
- Researchers and journalists get five open datasets, but only at aggregate level and with ethnic breakdowns stopping at province.
Open questions
The circular refers to an operating regulation for the poverty platform that the Minister has yet to issue, and to a national shared data dictionary into which this dictionary must be registered. It is silent on the fate of Quyết định 4092/QĐ-BNNMT and on how a household that disputes its data gets it corrected, beyond pointing to general personal data protection law. The 2026 review round will still use the 2022 to 2025 poverty standard, and the new 2027 to 2030 standard from Nghị định 351/2025/NĐ-CP arrives one year into the migration. The dictionary versions the standard by period, which is the right design, but the migration phases have no deadlines, so the real test is whether the 2027 review runs on the new structure or on the old spreadsheets.
